LEGAL STANDOFF: Mutamba & Mvonde Heard By Parliament Special Commission

A legal standoff between Minister of Justice Constant Mutamba and Attorney General Firmin Mvonde in the Democratic Republic of Congo (DRC) with the National Assembly intervening in the matter.

Last week, Firmin Mvonde, the Attorney General at the Court of Cassation, request the lifting of Minister of Justice, Constant Mutamba, to state the role he played in the alleged embezzlement of US$38 million at the ministry meant for the construction of a prison.

However, Mutamba reacted angrily to Mvonde’s request and vowed never to appear before him to prove his innocence citing that the Attorney General was not legally bound to prosecute him.

The parliament-appointed commission first heard from Mvonde on the terms of his request for authorization to prosecute Mutamba who was also later heard.

The committee’s office is chaired by MP Mechack Mandefu who will be assisted by Mbiya Luboya Titi as first vice-president and Théovel Lotika as second vice-president.

MP André Lite is designated rapporteur and Désiré Iwolo Banyafia as deputy rapporteur.

Composed of 23 members in total, this commission has only three days, from May 26 to 28, 2025, to analyze in depth, the indictment of the High Magistrate of the Civil Prosecutor’s Office.

The hearing report is set to be presented at the plenary session on Thursday, May 29.
